1832 Deed: Elizabeth GARDNER to Peter J. MEAD

This indenture made this sixteenth day of January in the year of our Lord one thousand eight hundred and thirty two between Elizabeth Gardner of the Township of Orange in the County of Essex and State of New Jersey of the first part and Peter J. Mead of the city and state of New York of the second part -

Witnesseth that the said party of the first part for and in consideration of the sum of seven hundred dollars lawful money of the United States of America to her in hand paid at or before the  ensealing and delivery of these presents by the said party of the second part the receipt whereof is hereby acknowledged and the said party of the second part his heirs executors and administrators forever released and discharged from the same by these presents had granted bargained sold aleined remised released conveyed and confirmed and by these presents doth grant bargain sell alein remise release convey and confirm unto the said party of the second part and to his heirs and assigns forever all that tract of land hereinafter particularly described -

Situate lying and being in the Township of Pequanac in the County of Morris and State of New Jersey beginning at a post and stone being the south corner of the said Elizabeth Gardner’s land also a corner of Cornelius [?] and Anthony Mandeville’s land thence running along the line of Cornelius [?] north four degrees west fourteen chains and sixty five links to the land of Anthony Mandeville thence along the same (2) north eighty nine degrees east ten chains and twenty five links (3) south four degrees east fourteen chains and sixty five links to the land of Anthony Mandeville thence (4) along the same south eighty nine degrees west ten chains and twenty five links to the beginning containing fifteen acres strict measure .

Together with all and singular the [?] hereditaments and appurtenances whatsoever unto the said above mentioned and described premises in any wise appertaining or belonging and the [?] and remainder and remainders rents [?] and profits thereof and also all the estate right title interest dower and right of dower property possession claim and demand whatsoever as writ in law as in equity of the said party of the first part of in or two the same and every part and parcel thereof with the appurtenances -

To have and to hold the above granted bargained and described premises with the appurtenances unto the said party of the second part his heirs and assigns to his or their own proper use benefit and behoof forever and the said Elizabeth Gardner for herself her heirs executors and administrators doth covenant grant promise and agree to and with the said party of the second part his heirs and assigns [?] the said Elizabeth Gardner at the time of the sealing and delivery of these presents was lawfully seized in possession of a good [?] and [?] estate of inheritance in fee simple of and in all and singular the above granted bargained and described premises with the appurtenances thereunto belonging and have [?] lawful authority to grant bargain sell and [?] the same in manner and [?] aforesaid and that the said party of the second part his heirs and assigns shall and may at all times hereafter [?] occupy possess [?] and [?] the above granted premises and every part and parcel thereof with the appurtenances [?] the said party of the first part her heirs and assigns or of any other person or persons lawfully [?] or to claim the same and that the [?] now are [?] discharged and unencumbered and from all [?] and other grants titles [?] estates judgements taxes [?] and incumbrances of what nature or kind soever -

And also that the said party of the first part and her heirs and all and every [?] person or persons whomsoever lawfully or equitably deriving any estate right title or interest of in or two the herein before granted premises by [?] under or in trust for them shall and will at any time or times hereafter upon the reasonable request and at the proper [?] and charges of the law in the said party of the second part his heirs and assigns or his counsel learned in the law shall be reasonably [?] advised or [?] and the said Elizabeth Gardner her heirs the above described and hereby granted and released premises and every part and parcel thereof with the appurtenances unto the said party of the second part his heirs and assigns against the said party of the first part and her heirs and against all and every person and persons whomsoever lawfully claiming or to claim the same shall and will warrant and by these presents forever defend. Know all men by these presents that I Elizabeth Gardner, widow of Christopher Gardner deceased, for and in consideration of the sum of ten dollars a year during my lifetime to be paid yearly at the end of every year.

I have remised, released and forever quit claimed and by these presents do demise release and forever quit claim unto Anthony D. Thompson his heirs and assigns all and all manner of dower which I now have or might or should of right have of in or to or act of all and every part of the lands and farm that lays in the Township of Jefferson, County of Morris, State of New Jersey that William and Christopher Thompson formerly occupied and purchased of my husband and all manner of actions writ and writs of dower whatever so that neither I or any person for me or in my name any manner of dower of or in the said messages lands and tenaments or any part thereof at any time hereafter shall or may have claim or prosecute -

This indenture made the sixth day of June in the year of our Lord one thousand eight hundred and five between Christopher GARDNER of Sussex County and State of New Jersey of the one part and Gersham MORRIS of Morris Township, County of Morris and State of New Jersey of the other part.

Witnesseth that the said Christopher Gardner for and in consideration of the sum of Four hundred and eight dollars and sixty two cents to him in hand paid by the said Gersham Morris the receipt of which is hereby acknowledged and the said Christopher Gardnerto be therewith fully satisfied contented [?] hath given granted bargained and sold aliened released enfeoffed conveyed and confirmed and by these presents do fully and absolutely grant bargain [?] enfeoff convey and confirm unto the said Gersham Morris his heirs and assigns forever all and singular the following [?] or present of land and premises situate and being in Morris Town aforesaid and in the Great Swamp -

Beginning at a stake the corner of the said Gersham Morris land and running on said Gersham Morris’s land (1) south eighty six and a half degrees east seventeen chains and sixty links to a stake for a corner thence (2) north one and a half degrees west two chains to a red oak sapling for a corner thence (3) south eighty one degrees east ten chains and twenty four links to a stake for a corner thence (4) running on the line of Jacob Holes land south twenty five degrees east twelve chains and seventy one links to a stake for a corner thence (6) north eighty one degrees west eleven chains and eight links to a stake being a corner of Jacob Brants line thence (7) in the line of said [Butler?] north twenty nine and a half degrees east five chains and eighty two links to a white oak tree thence (8) north thirty six degrees west eight chains and forty seven links of an acre of land be the same more or less -

Together will all once singular the profits priveleges and advantages with the appurtenances to the same belonging or in any manner of wise appertaining also all the estate right title interest property claim and demand of what kind soeverof the said Christopher Gardner of in and to the same and to every part and parcel thereof to have and to hold the said tract or parcel of land and premises with the appurtenances unto the said Gersham Morris his heirs and assigns to the only proper use benefit and behoof of the [?] Gersham Morris his heirs and assigns forever and the said Christopher Gardner for himself his heirs executors and administrators doth covenant grant and agree to and with the said Gersham Morris his heirs and assigns that the said tract of land and premises is not incumbered by any mortgages judgement dower [?] or limitation or by any incumbrance whatsoever -

Also that he the said Christopher now hath good right full power and lawful authority to sell dispose of the sums in manner as aforesaid and that he is lawfully seized thereof in his own proper right as a good perfect and absolute estate of inheritance in fee simple -

And the said tract of land [?] unto the said Gersham Morris his heirs and assigns he the said Christopher Gardner will warrant [?] and by these presents forever defend against the lawfull claims and demands of all and every person and persons free and clear and clearly freed and discharged of and from all manner of incumbrances in the law whatsoever. In witness whereof the said Christopher Gardner and Betsey his wife have hereunto set their hands and seals this day and year first above written -

I believe that the Nancy ALLINGTON in Monmouth BENSON’s household is the same person as Nancy GARDINER, who married Benjamin ALLENTON. Nancy GARDINER and Benjamin ALLENTON had at least two daughters, Sarah ALLINGTON (married Anson BARTON) and Nancy ALLINGTON (married Anson BARTON after the death of her sister Sarah).

The Elizabeth BENSON in this household is listed in other census records as “Elizabeth A. BENSON”. I have other female ancestors from this family that kept their maiden name as a middle name, and it was often represented by a middle initial when listing their names. Nancy GARDINER’s mother’s name was Elizabeth. This makes me think it’s possible that the Elizabeth A. BENSON in this household was Elizabeth ALLINGTON BENSON, and that Nancy GARDINER ALLINGTON was her mother.

The Elizabeth GARNER that signed this deed was Christopher GARNER (GARDINER)’s widow.

The land that the ALLENTONS and WINANS inherited from Christopher GARNER (GARDINER) was in Jefferson Township, Morris County, but only three quarters of a mile from the northeast corner of Morris County. Because of Morris County’s shape it’s hard to define a northeast corner, but looking at it’s shape today that area would have bordered Pompton and Saddle River Townships in Bergen County and Caldwell (possibly also Aquackanonck) in Essex County in 1805. On it’s western end Jefferson borders Hardyston Township, Sussex County, where the ALLENTONS and WINANS lived.

This indenture made the eighth day July in the year of our Lord one thousand eight hundred and five, between Daniel ALENTON and Rachel his wife, Benjamin ALENTON and Nancy his wife, John WINANS and Caroline his wife all of the Township of Hardiston in the county of Sussex and state of New Jersey of the one part and William THOMPSON and Christopher THOMPSON of the township of Jefferson in the county of Morris and state aforesaid of the other part

Witnesseth that the said Daniel ALENTON and Rachel, Benjamin ALENTON and Nancy, John WINANS and Caroline for and in consideration of the sum of eight hundred and eight dollars and sixty seven cents to them in hand paid by the said William and Christopher THOMPSON the receipt whereof is hereby acknowledged hath granted and sold by these presents doth grant bargain sell release enfeoff convey and confirm unto the said William and Christopher THOMPSON their heirs and assigns forever all that tract of land situated in the township of Jefferson in the county of Morris and state of New Jersey,

1778, 1780: NJ Rateables for Pequannock Township, Morris County, A-B

According to this rateables list, Benjamin ALLENTON lived in Pequannock Township, Morris County in 1778 and 1780 (during the Revolutionary War). He was a householder in 1778, although he was not taxed on any improved land then. In 1780 he still apparently owned three horned cattle in Pequannock even though he was not a householder there any longer.

According to census records, the Nancy GARDINER who married Benjamin ALLENTON (ALLINGTON) was born about 1778. The Benjamin ALLENTON in this rateables list was old enough to own a house in 1778, which most likely means he was old enough to be Nancy GARDINER’s father if the census records are correct. Is it possible this Benjamin ALLENTON had a son also named Benjamin ALLENTON that married Nancy GARDINER?

Other names of interest are Jacob ALLENTON and William BUNTON. I don’t know if Jacob and Benjamin ALLENTON were related. I think it’s possible that William BUNTON is really William BARTON, who lived in Pequannock around the same time.

For each township, unless otherwise noted, the earliest list of rateables, usually 1778 or 1779, and one for 1780 have been reported here together. There was naturally a greater fluctuation of holdings during these war years.

The following abbreviations have been used:     c = horned cattle; ex = exempt; h = horse(s); h&l = house and small lot; hh = householder; p = hog(s); rc = riding chair; s = slave; sm = single man who works for hire; sm&h = single man who keeps a horse; u = acres of unimproved land; [pound monetary notation] = amount out at interest

A number without a following letter or letters indicates the number of acres of improved land taxed.

An asterisk indicates that the name was on the earlier list but not on the later one. Parentheses are placed around changes, and around the names and holdings of persons appearing on the second list but not the first. The same items were taxed in both years unless a change is indicated by parentheses. Thus, if Dirck Setven was taxed on 200 acres, 5 horses, 3 horned cattle, 2 hogs, 1 slave and 180 pounds at interest in 1778, and Richard Sutphin was taxed on 200 acres, 4 horses, 3 horned cattle, 2 slaves, 180 pounds and a riding chair in 1780, the entry would appear:

1866 Orphan Court Records: Estate of Anson BARTON, deceased

[from Passaic County New Jersey Orphan Court Records relating to the death of Anson BARTON, located in the Passaic County, NJ County Clerk's Office records vault]

The following transcript is only one document from a group of many Orphan Court documents relating to the estate of Anson BARTON. These records indicate that Anson BARTON died without a will and in debt to a store owner named Hezekiah TEMPLE, and a doctor. Because of this the Passaic County Orphan’s Court ordered his land to be auctioned off. He was survived by a widow.

We know from Willistine Cemetery Records in the Genealogical Magazine of New Jersey that Anson BARTON died 20 June, 1864

Passaic Orphans Court, Sept. 2, 1866

Anthony L. Day, Administrator of Anson Barton, dec’d } Decree on Sale

It appearing to the Court of the report of the said Administrator that in pursuance of an order to sell lands of Anson Barton, deceased, made by this Court on the twenty first day of April 1866 as yet of the Term of April in that year,

 the said administrator gave public notice of sale of said lands to take place at the house of Mrs. Barton in the Township of West Milford in Passaic County on July 10 1866 at the hour of two o’clock in the afternoon of that day by advertisements signed by himself and put up in five of the most public places in said Township two months next before said time and also by publishing the same for four weeks next before said time once a week successively in the Paterson Weekly Press a newspaper printed and published at Paterson in this State and circulating most generally in the neighborhood of said lands and that at the time and place of sale aforesaid he did sell the said lands to wit,

a lot of land containing one acre and a half with dwelling thereon conveyed to Anson Barton by Alexander Boyd by deed dated October 14, 1856 and recorded in Book E2 of deeds for Passaic County on pages 632, etc. unto Joel Harrison for the sum of Two Hundred and Seventy Five dollars, he being the highest bidder therefore for that sum;

and the said several matters appearing to the satisfaction of the Court to be true and no objections appearing or being made to said sale the same is by the Court here approved and confirmed as valid and effected in law; and it is ordered that the said administrator do execute a good and sufficient conveyance in the law to the said purchases for the land so as aforesaid sold to him.

1856 Deed: Alexander and Catherine BOYD to Anson BARTON

This indenture, made the fourteenth day of October in the year one thousand eight hundred and fifty six,

Between Alexander Boyd and Catherine J. Boyd, his wife, of the Township of West Milford in the County of Passaic and State of New Jersey of the first part,

And Anson Barton of the Township of West Milford in the County of Passaic and State of New Jersey of the second part,

Witnesseth, that the said Alexander Boyd and Catherine J., his wife, for and in consideration of the sum of three hundred and sixty dollars lawful money of the United States of America, to them in hand well and truly paid by the said party of the second part, at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, and the said parties, of the first part therein fully satisfied, contented and paid, have aliened, remised, released, and forever quit claimed and by these presents do alien, remise, release and forever quit claim unto the said party of the second part, and to his heirs and assigns,

All that tract or parcel of land and premises hereinafter particularly described, situate, lying and being in the Township of West Milford in the County of Passaic, and State of New Jersey.

Also all the estate, right, title, interest, property, claim and demand whatsoever of the said parties of the first part of in and to every part, and parcel thereof,

To have and to hold all and singular the above described tract or parcel of land and premises, with the appurtenances unto the said party of the second part, his heirs and assigns to the only proper use, benefit and behoof of the said party of the second part, his heirs and assigns, forever,

And the said Catherine J. Boyd being by me privately examined, separate and apart from her said husband she did further acknowledge that she signed, sealed and delivered the same as ehr voluntary act and deed, freely and without any fear, threats or compulsion of or from her said husband.
